1. INTRODUCTION

These terms and conditions (“Agreement”) govern the use of the online training services provided by the South African Home Inspection Training Academy (SAHITA) (“the Academy,” “we,” “us,” or “our”), accessible via www.sahita.co.za (“the Website”).

By registering for a course, webinar or workshop, accessing, or using our Website and services, you (“the User,” “you,” or “your”) agree to be bound by and comply with these terms. If you do not agree, you must not proceed with registration or use of our services.

2. DEFINITIONS

• Academy: SAHITA, a provider of online building and home inspection training services.
• Website: www.sahita.co.za and all associated pages, content, and services.
• Course: Any online training programme, or webinar or workshop as advertised from time to time by SAHITA on the Website.,
• User: Any person who registers for, accesses, or uses the Academy’s services.
• Intellectual Property (IP): All course content, materials, designs, logos, trademarks, and proprietary information.
• Fees: Course or webinar or workshop fees as detailed on the Website.

3. ACCEPTANCE OF TERMS

3.1. By accessing the Website or registering, you confirm you have read, understood, and agree to these terms.
3.2. You warrant that you are at least 18 years old and have the legal capacity to enter this Agreement. If under 18, you must obtain parental or guardian consent.

4. REGISTRATION AND USER ACCOUNT

4.1. Registration requires accurate, current, and complete information, which you must keep updated.
4.2. You are responsible for maintaining account confidentiality and notifying us immediately of unauthorised access.
4.3. Accounts are non-transferable; sharing access is prohibited.
4.4. Upon payment, you gain immediate access to the Course materials and can commence studies.

5. PAYMENT AND FEES

5.1. Course fees differ depending on the course or webinar/workshop and are as advertised on the Website at the time of Registration by the User.
5.3. Payments accepted via electronic funds transfer (EFT) or through the secure third party payment gateway PayFast. All prices include VAT where applicable.
5.4. Full payment (or first instalment) is required before access is granted. We comply with ECTA by providing supplier details (SAHITA, physical address, contact information) and electronic transaction records.

6. CANCELLATION AND REFUND POLICY

6.1. User Cancellation: Per CPA Section 44, you may cancel within 7 days of payment for a full refund, provided no Course materials have been accessed or downloaded. Refunds will be processed within 15 business days, less any bank charges. No refunds after the 7-day period or once access has commenced.
6.2. Academy Cancellation: We reserve the right to cancel or postpone a Course (e.g., due to low enrolment). In such cases, a full refund will be issued.
6.3. Instalment plans: Cancellation does not relieve you of outstanding payments unless within the CPA cooling-off period.

7. COURSE ACCESS AND COMPLETION

7.1. Access to the tuition material as advertised is made available to the User upon receipt of the payment of the required fees.
7.2. Support: Available via phone (number as advertised on the Website) or email (info@sahita.co.za).
7.3. Certification: Issued upon full payment, successful completion and adherence to terms.

8. INTELLECTUAL PROPERTY RIGHTS

8.1. The Academy owns all IP in all Course materials as advertised on the Website
8.2. The User receives a limited, exclusive, non-transferable licence for personal, non-commercial use.
8.3. Prohibited: Reproduction, redistribution, modification, or sharing without written permission. Breaches may result in termination and legal action.

9. USER CONDUCT

9.1. Use services lawfully and professionally.
9.2. Prohibited: Violating laws, infringing IP, transmitting offensive material, or engaging in malicious activity (e.g., hacking).
9.3. Breaches may lead to account suspension, Course termination, and no refunds.

10. LIMITATION OF LIABILITY AND DISCLAIMER

10.1. Course materials are for informational purposes; we do not guarantee suitability for your needs.
10.2. To the extent permitted by law, the Academy is not liable for direct, indirect, or consequential damages from Website/Course use.
10.3. The Website is provided “as is”; we do not warrant freedom from errors, viruses, or interruptions.

11. DATA PROTECTION AND PRIVACY

11.1. We comply with POPIA in collecting, processing, and protecting personal data (e.g., for registration, payments, and support).
11.2. Data is used solely for Course administration; explicit consent is required for processing. View our Privacy Policy on the Website.
11.3. Security: SSL encryption and secure gateways used; you consent to cookie use (with opt-out).

12. GOVERNING LAW AND JURISDICTION
